Enterprise Consumer Right of Withdrawal & Return Policy

1. Consumer Integrity Mission Statement

Nexly.biz (the “Company”) is committed to absolute transparency in its commercial relations. Our mission is to ensure that every consumer feels secure in their purchasing decisions. We view the Right of Withdrawal not as a hurdle, but as a primary customer integrity safeguard that fosters trust and long-term institutional loyalty.

2. Universal Structural Scope

This policy governs the cancellation of contracts for both physical goods and digital services acquired through the Nexly marketplace by "Consumers" (individuals acting for purposes outside their trade, business, or profession). Global corporate/B2B transactions are subject to separate master service agreements.

3. EU Directive 2011/83/EU Alignment

Nexly operates in symbiotic alignment with the EU Consumer Rights Directive. We provide a standardized "Withdrawal Protocol" that ensures consumers across the European Union and the United Kingdom can exercise their cooling-off rights without friction.

4. The 14-Day Cooling-off Period

Consumers have the right to withdraw from a contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day of the conclusion of the contract (for services) or the day on which the consumer acquires physical possession of the goods.

5. Digital Content & Service Exceptions

The right of withdrawal expires prematurely for:

  • Digital Content: If the performance has begun with the consumer’s prior express consent and acknowledgment that they thereby lose their right of withdrawal (e.g., instant course unlocking).
  • Specialized Bundles: Customized educational paths or physical assets personalized for the learner.

6. Consequences of Withdrawal

If you withdraw from a contract, Nexly shall reimburse all payments received from you, including the costs of delivery (with the exception of supplementary costs resulting from your choice of a delivery type other than our least expensive standard delivery).

7. Refund SLAs & Triage

We commit to processing reimbursements within 14 days from the day on which we are informed about your decision to withdraw. Reimbursement will be executed using the same payment node utilized for the initial transaction, unless otherwise agreed.

8. Return Logistics & Costs

For physical goods, the consumer must send back the goods without undue delay. The direct cost of returning the goods will be borne by the consumer, unless the product is defective or subject to a "Recall Event" as defined in our Product Recall Policy.

9. Liability for Loss of Value

The consumer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. We utilize high-fidelity forensic audits for returned hardware to verify integrity.

10. Digital Withdrawal Terminal

11. Process Triage & Integrity Verification

Upon submission, your request is logged in our "Consumer Integrity Ledger." Our triage team will verify the contract date and asset status within 48 hours. If the request is valid, we will provision your return authorization and initiate the refund sequence.

12. ODR Arbitration & Fairness

Should a dispute arise regarding your withdrawal, we recommend utilizing the European Online Dispute Resolution (ODR) platform. Nexly is committed to fair adjudication and will participate in mediation if internal resolutions fail to meet your expectations.
